30% Of Estate Agents Ignoring EPC Legislation

 

An industry body has found that 30% of estate and letting agents are ignoring the requirements of legislation regarding Energy Performance Certificates (EPCs).

The research from Property and Energy Professionals Association (PEPA) suggest that agents are routinely ignoring their legal duty to provide EPCs. In addition to this they found a further 70% of agents are failing to upload the EPC details when they do receive them.

At present, the law requires estate and letting agents to have ordered an EPC by the time a property is placed on the market, and then to upload the details within 28 days.

However, PEPA states that rule-breaking is so prevalent, the regulations so poorly drafted and enforcement so haphazard that the situation should be clarified - ideally by requiring the EPC to be made available immediately when the property is listed for sale or to rent.

Mike Ockenden, Founder of PEPA, has called for an amendment to be made to the Energy Performance of Buildings Directive (EPBD), stating: “I am not having a pop at agents. I wouldn’t criticise anyone's behaviour in today’s poor market. However, the regulations are likely to be rewritten anyway, and I think it would be sensible to include this revision – it would make things clearer for everyone.”
